These Terms of Service (“Terms”) govern your access to and use of FocusFlow software, our website, and related services (“Services”). By installing the extension, visiting our site, or purchasing a license, you agree to these Terms.
Agreement to terms
If you do not agree, do not use the Services. You must be legally able to enter a binding contract in your jurisdiction. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
Description of services
FocusFlow is a browser extension and associated materials designed to support focus and productivity. Features may change over time. We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable.
License grant
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the extension for your personal or internal business purposes in accordance with the plan you purchase. You may not copy, modify, reverse engineer, distribute, or create derivative works of the software except as allowed by applicable law.
Purchases and Lemon Squeezy
Payments may be processed by Lemon Squeezy or another designated payment provider. Pricing, taxes, and invoicing are presented at checkout. You agree to provide accurate billing information and to comply with the payment provider’s terms in addition to these Terms.
Refund policy
Refund Policy: We offer a 14-day free trial so you can test the software completely risk-free. Due to the digital nature of the license key, all sales are final once purchased, unless required otherwise by local law.
Statutory withdrawal or cooling-off rights may apply in your region despite the foregoing; nothing in these Terms limits non-waivable consumer protections.
Acceptable use
You agree not to:
- Use the Services in violation of law or third-party rights;
- Attempt to gain unauthorized access to our systems or other users’ data;
- Interfere with or disrupt the integrity or performance of the Services;
- Use the Services to distribute malware or engage in abusive automated access;
- Resell, sublicense, or share license keys except as expressly permitted.
Intellectual property
FocusFlow, its branding, and the extension are protected by intellectual property laws. Except for the limited license above, we reserve all rights. Feedback you provide may be used by us without obligation to you.
Third-party services
The extension operates within your browser and may interact with websites you visit. Your use of third-party sites is governed by those sites’ terms. We are not responsible for third-party content or services.
Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FOCUSFLOW OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY U.S. DOLLARS (USD $50), EXCEPT WHERE PROHIBITED BY LAW.
Indemnity
You will defend and indemnify FocusFlow and its affiliates against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services or violation of these Terms.
Termination
We may suspend or terminate your access if you materially breach these Terms. You may stop using the Services at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations, and indemnity) will survive termination.
Governing law
These Terms are governed by the laws of the jurisdiction we designate in your order or checkout flow, excluding conflict-of-law rules. Courts in that jurisdiction have exclusive venue, except where mandatory consumer rules require otherwise.
Changes
We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date. Continued use after changes become effective constitutes acceptance, except where additional consent is required by law.
